Agreement to our legal terms

The following terms and conditions, together with any documents and/or additional terms they expressly incorporate by reference constitute a legal agreement (collectively, this "Agreement") and are entered into by and between you ("you", "your", "User") and RareJet ("Company" "we" "us", & "our").

This Agreement contains very important information regarding your rights and obligations, as well as conditions, limitations, and exclusions that apply to your access and use of flyrarejet.com (the “Website”). Please read the Agreement carefully. If any provision is invalid, the rest remain enforceable.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and RareJet, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms from time to time. We will alert you about any changes by updating the "Last updated" date of these Legal Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Legal Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Legal Terms by your continued use of the Services after the date such revised Legal Terms are posted.

The Services are intended for users who are at least 16 years of age. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Services. If you are a minor, you must have your parent or guardian read and agree to these Legal Terms prior to you using the Services.

We recommend that you print a copy of these Legal Terms for your records.

1. Introduction

This website is owned and operated by RareJet. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors joyflights on unique aircraft. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

2. Third-party service providers

RareJet acts as a booking agent and organizer for flights operated by independent, locally licensed air operators in the country where the flight takes place. The actual carriage by air is performed by the operating carrier under its own Air Operator Certificate (AOC) and under the laws and regulations of that country. By completing a booking, you enter into (1) a contract with RareJet for the booking and organization services, and (2) a separate contract of carriage with the operating carrier. The operating carrier’s conditions of carriage will also apply to the flight itself. RareJet is not an air carrier and does not own or operate aircraft.

3. Changes to flight

All flights are operated by third-party airlines. As such, RareJet is not responsible for flight delays, cancellations, or schedule changes due to weather, mechanical issues, or operational constraints. In case of a cancellation, you will be notified as soon as possible and will be given a full refund.

The operating carrier may substitute the aircraft type or registration due to operational, technical, safety, or regulatory requirements. Such substitution does not constitute a cancellation, provided the flight is operated as scheduled. No refunds are due solely due to aircraft substitution.

Where applicable, passenger rights under EU Regulation 261/2004 apply directly with the Operating Carrier.

4. Insurance & liability waiver

By using our services, you acknowledge that aviation activities involve inherent risks. RareJet does not provide passenger insurance. Passengers are encouraged to obtain personal travel insurance for additional protection. RareJet assumes no liability beyond what is required by applicable laws.

5. Passenger safety

All flights are operated by locally licensed air operators in the country where the flight takes place. The operating carriers hold valid Air Operator Certificates and permits issued by their national civil aviation authority. These aircraft and operators comply with all applicable local aviation regulations.

6. Passenger conduct

By using our services, you must comply with all instructions given by the flight crew and airline staff. The operating airline reserves the right to refuse boarding or remove any passenger from the aircraft if their behavior is deemed disruptive, unsafe, or unlawful. RareJet is not responsible for such decisions, as they are at the sole discretion of the operating airline. No refunds will be issued in such cases.

7. Photography & media consent

Passengers may be photographed or recorded during flights or related events. By participating, you grant RareJet a non-exclusive, royalty-free right to use such images or recordings for promotional and documentation purposes, unless you notify us in writing prior to the flight.

8. Eligibility

The minimum required age for participants flying unaccompanied is listed in the details for every flight. Persons under 16 may only participate if a parent or legal guardian makes the booking on their behalf, signs the liability waiver, and accompanies them (where permitted by the operator). If you are flying unaccompanied as 16-18 years old, you must have a consent letter signed by your parents. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

9. Purchasing & Payments

When using our services, you agree that:
(i) you are responsible for reading the full item listing before making a commitment to buy it.

(ii) you accept the terms and conditions.
(iii) you enter into a legally binding contract to purchase an item when you commit to buy an item and complete the checkout payment process.

The prices we charge for using our services or for our products are listed on the website. We reserve the right to change our prices for products displayed at any time and to correct pricing errors that may inadvertently occur. 10. Refund & Cancellation Policy

The following refund policies apply to the services provided by RareJet:

I.In case your flight gets cancelled by RareJet or the operating airline, you are entitled to a full refund.

II. If you cancel your flight 60 days before the flight, you are entitled to a full refund.

III. If you cancel your flight 30-60 days before the flight, you are entitled to 50 % refund.

IV. If you cancel your flight under 30 days before the flight, you are not entitled to a refund.

V. If your flight is cancelled, you will receive a full refund automatically.

RareJet shall not be held liable for any additional expenses or financial losses incurred by the passenger as a result of the cancellation, including but not limited to accommodation, alternative transportation, meals, or missed connections. However, the operating carrier might be accountable for compensations depending on the regulations of the country of flight.

We strongly recommend that all passengers obtain travel insurance that covers such contingencies.

Where applicable, passenger rights under EU Regulation 261/2004 apply directly with the Operating Carrier.

11. Service Modifications & Termination

We may, without prior notice, modify the Services, discontinue specific Services or features, or impose reasonable limitations where required for operational, technical, safety, legal, or regulatory reasons.

We may permanently or temporarily terminate or suspend access to the Services where:
(i) you materially breach these Terms;
(ii) fraud, misuse, or unlawful activity is suspected;
(iii) such action is required by law, regulation, or a competent authority; or
(iv) continued provision of the Services becomes commercially or operationally impracticable.

Where termination or suspension occurs for reasons not attributable to you, any prepaid but unused Services will be refunded in accordance with these Terms.

You may discontinue use and request cancellation of your account and/or Services at any time. With respect to automatically renewed subscriptions to paid Services, such subscriptions will be discontinued upon the expiration of the period for which payment has already been made.

12. Intellectual Property

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and all Intellectual Property Rights related thereto, are the exclusive property of RareJet. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works thereof.

13. Liability & Disclaimer of Warranties

To the maximum extent permitted by applicable law, RareJet shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Services. In no event shall our total liability exceed the amount actually paid by you for the booking. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

14. Indemnification

You agree to indemnify and hold RareJet harmless from any demands, loss, liability, claims, or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

15. Changes to Terms & Conditions

We reserve the right to modify these Terms from time to time. The “Last updated” date at the bottom of these Terms will indicate when changes were made.

Where changes materially affect your rights or obligations, we will take reasonable steps to bring such changes to your attention. Your continued use of the Website or Services following the effective date of any updated Terms constitutes acceptance of the revised Terms. If you do not agree, you must discontinue use of the Website and Services.

16. Marketing & Communications

You will only receive promotional or marketing communications from RareJet where you have provided your explicit consent, such as by subscribing to a newsletter or opting in via a non-pre-ticked checkbox.

Consent to receive marketing communications is voluntary and not a condition for booking or using the Services. You may withdraw your consent at any time by following the unsubscribe instructions included in such communications or by contacting us.

17. Governing Law & Dispute Resolution

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under, and enforced in all respects solely and exclusively in accordance with the internal substantive laws of Finland, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Helsinki. If you are a consumer resident in the European Union, the mandatory consumer protection provisions of your country of residence shall apply notwithstanding the choice of Finnish law. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.

18. Privacy

We collect and process your personal data in order to fulfill your booking, respond to enquiries, send newsletters (with your consent), and comply with aviation security requirements. This includes:

Data Collected: Names, email addresses, phone numbers, passport details, health information, payment details, and other data where required (e.g., IP addresses from forms).
Purposes: For contact enquiries (to respond to you, based on legitimate interest); for newsletters (to send updates, based on your explicit consent); for bookings (to process and share with operating carriers, based on contract necessity).
Legal Basis: Consent for marketing/newsletters; legitimate interest for enquiries (with opt-out available); contract for bookings; legal obligation for security data.
Retention: Enquiry data for 1 year after response; newsletter emails until you unsubscribe; booking data for 5 years or as required by law.
Sharing: With service providers (e.g., email service providers under data processing agreements) and operating carriers for bookings. No sharing for marketing without consent.
Security: We use encryption, access controls, and other measures to protect your data.
International Transfers: If using non-EU providers, we rely on Standard Contractual Clauses or other safeguards.
Your Rights: You have the right to access, rectify, erase, restrict, or object to processing of your data, as well as data portability. To exercise these rights, contact us at contact@flyrarejet.com. You can also lodge a complaint with the Finnish Data Protection Ombudsman. Your data is handled in accordance with our full Privacy Policy, which can be found at: https://www.flyrarejet.com/privacy-policy. By submitting data (e.g., via contact forms or newsletter sign-ups), you confirm you have read the Privacy Policy. For newsletters and marketing, we require separate explicit consent via a non-pre-ticked checkbox. If our site uses cookies or analytics (e.g., for tracking), we will provide a separate cookie consent banner in compliance with the ePrivacy Directive.
